This Terms and Conditions Agreement (hereinafter referred to as "this Agreement" or "Terms") constitutes a formal, legally binding contract between ALEGIAN TECHNOLOGY GROUP LTD., INC. (a corporation duly organized and existing under and by virtue of the laws of the Republic of the Philippines; hereinafter referred to as the "Company", "we", "us", or "our") and the individual user (hereinafter referred to as the "User", "you", or "your") who accesses, downloads, installs, registers with, or uses the Easycash mobile application or its official website `https://www.alegiantech.com/` (collectively referred to as "the Platform" or "the Application").
By checking "Agree", registering an account, accessing, or using the Platform, you acknowledge and warrant that you are at least 18 years of age, possess full civil capacity to contract, and have carefully read, fully understood, and unconditionally agreed to be bound by this Agreement, our Privacy Policy, and all compliance guidelines published on the Platform from time to time. If you do not agree to any term of this Agreement, please exit and immediately cease accessing the Platform, uninstall the Application, and refrain from utilizing any of the Platform's services.
All operational activities, digital loan matchmaking services, and subsequent account processing conducted through the Platform strictly comply with the relevant laws, decrees, circulars, and compliance guidelines of the Republic of the Philippines, including but not limited to:
1.Republic Act No. 3765 (Truth in Lending Act): We and our partner financial institutions covenant to provide 100% transparent and complete disclosure of all interest rates, fees, penalties, and financial costs to the borrower prior to the consummation of any credit transaction.
2.Republic Act No. 9474 (Lending Company Regulation Act of 2007): Ensuring that the funding entities integrated into the Platform possess statutory licenses for online credit underwriting and financing.
3.Securities and Exchange Commission (SEC) Memorandum Circular No. 19, Series of 2019: Regarding corporate disclosure, advertising compliance, and transparency requirements for Online Lending Platforms (OLPs).
4.SEC Memorandum Circular No. 18, Series of 2019 and Memorandum Circular No. 5, Series of 2023: Strictly prohibiting any form of unfair, harassing, abusive, coercive, or privacy-invasive debt collection practices.
5.Republic Act No. 10173 (Data Privacy Act of 2012 or DPA): Strictly safeguarding the security of users' personal information.
6.Republic Act No. 9510 (Credit Information System Act or CISA): Lawfully reporting and querying credit histories with the Credit Information Corporation (CIC).
To afford users the highest standard of regulatory transparency, the division of responsibilities and roles between the Company (Platform Technology Operator) and the partner NBFC (Actual Lender/Funding Entity) is clearly defined as follows:
●Intermediary and Loan Service Provider (LSP): The Company is the developer, owner, and maintenance entity of the Platform. The Company itself is not a bank, a Non-Bank Financial Company (NBFC), or a licensed lending investor, and does not directly extend loans, credit lines, or disburse funds to users.
●Platform Technical Support: The Company is responsible for the technical deployment of the front-end digital interface, network transmission encryption, device fingerprinting risk interception, and front-line customer service (handling technical and data inquiries via the official inbox support@alegiantech.com).
●Primary Credit Underwriting Entity: All loan underwriting, credit limit evaluations, financial risk reviews, and the final disbursement of loan funds on this Platform are handled and operated solely by our deeply integrated partner licensed non-bank financial company — Easycash Lending Company Inc. (hereinafter referred to as the "Partner NBFC").
●Contractual Counterparty: The Partner NBFC is the actual lender and creditor of the funds. Upon successful loan approval via the Platform, the User will execute a legally binding Loan Agreement online directly with the Partner NBFC.
The Platform automatically tracks, compiles, and analyzes information that you authorize us to collect, enabling the Partner NBFC to perform risk underwriting assessments.
●Loan Amount: Minimum ₱1,000 Pesos to maximum ₱100,000 Pesos. The actual approved limit is determined comprehensively by the Partner NBFC based on the applicant's credit score.
●Loan Tenure: Minimum 91 days to maximum 365 days.
●Annual Percentage Rate (A.P.R.): 16% to 30%. The actual interest rate is dynamically priced based on the user's credit profile and performance.
●Comprehensive Fee Structure: * Service/Processing Fee: A certain percentage of the platform matchmaking service fee may be charged upon principal drawdown.
○Applicable Taxes: Pursuant to the regulations of the Bureau of Internal Revenue (BIR) of the Philippines, service fees may be subject to corresponding Value-Added Tax (VAT) or Documentary Stamp Tax (DST).
○Late Payment Penalties: Failure to repay on the scheduled date will incur late payment penalties, the charging standards of which are strictly capped within legal limits and clearly detailed in the Loan Agreement.
When utilizing the Platform, you must make the following statutory representations and warranties to us and the Partner NBFC:
●You must be a legal resident or citizen of the Philippines, and currently physically present within the territory of the Philippines;
●You are at least 18 years of age and possess full civil capacity and legal authority to execute contracts;
●You hold a stable and legitimate source of income (employment, self-employment, or freelance), possessing the financial capacity to discharge debts on time;
●You fluently understand English or Tagalog, and voluntarily execute online digital contracts via electronic signature;
●All KYC (Know Your Customer) materials, government-issued identification cards (such as UMID, SSS, TIN, Passport, PhilSys ID, etc.), and financial details submitted by you are authentic, accurate, current, and non-misleading.
You covenant that when using the Platform, you are strictly prohibited from:
●Utilizing loan funds for money laundering, gambling, terrorist financing, or any illegal purposes in violation of the laws of the Philippines;
●Registering, controlling, or maintaining more than one active account, or misrepresenting or misappropriating another individual's identity, mobile number, or e-wallet (such as GCash or Maya) information to submit credit requests;
●Interfering with the cybersecurity safeguards of the Platform, reverse engineering the Application, hacking, or using automated scripts or bots for data scraping;
●Submitting fraudulent reference (emergency contact) details. You warrant that the emergency contacts you provide have given their explicit prior knowledge and consent, allowing their contact info to be shared with us solely for compliant background verification or as compliant emergency contact channels should you become unreachable.
To facilitate your loan application and identity verification, the Company will collect and process your personal data (including identity details, facial biometric selfies, employment status, geographical location, and technical device parameters) in accordance with the Platform's Privacy Policy, subject to your explicit pop-up authorization.
We and the Partner NBFC strictly adhere to the lawful boundaries mandated by the National Privacy Commission (NPC) and the Securities and Exchange Commission (SEC) concerning permission access for online lending platforms. Although we invoke certain device permissions (such as contact lists) during the risk control phase, we make an ironclad commitment: we will never use your contact list information for unauthorized debt collection or harassment; we will never contact any third party in your directory who is not explicitly designated as a specific reference; we strictly prohibit "contact list bombing," verbal abuse, public exposure of privacy, intimidation, threats, or any other unfair or uncivilized debt recovery practices.
1.Refunds for Overpayment: Duplicate repayments or overpaid amounts resulting from financial settlement system latency will, upon back-end reconciliation and verification by the Company and the Partner NBFC, be refunded in full to your original payment channel or bank account within seven (7) working days.
2.Non-Cancellable Policy: Once the loan funds approved by the lender (Partner NBFC) have been successfully transferred into your designated bank account or e-wallet (GCash/Maya), the digital financial credit service is deemed fully completed and executed. You may not request to cancel or rescind the loan. You are bound to repay the loan in full and on time pursuant to the terms covenants in the Loan Agreement and the Disclosure Statement.
3.User Indemnification Liability: If a User provides fraudulent information, misappropriates identities to obtain credit, or maliciously defaults, thereby causing property loss, litigation costs, or administrative penalties to the Company or the Partner NBFC, the User shall bear full liability for all defense costs and indemnification damages.
●Amendment Mechanism: The Company reserves the right to modify or update these Terms at any time. Amended terms shall automatically become legally effective twenty-four (24) hours after being published on the Platform. We will notify you of material changes via in-app pop-ups, system push notifications, or your registered email. Your continued use of the Platform after changes have been posted constitutes your complete acceptance of the amended Terms.
●Suspension and Termination: If a User breaches this Agreement, is suspected of fraudulent credit activities, money laundering, or improper utilization of the Platform, the Company and the Partner NBFC reserve the right, without prior notice, to freeze your account, restrict, suspend, or permanently terminate your access to the Platform at any time.
●Ownership of Intellectual Property: The Easycash brand name, logos, platform interface design, source code, system algorithms, and all copyrighted contents are the exclusive property of the respective rightsholders and the Company, protected by the laws of the Republic of the Philippines and international intellectual property treaties.
●Third-Party Links: Any third-party repayment channels or advertising links integrated into the Platform are provided solely for your convenience. Your access to these links is entirely at your own risk and is governed by the terms and policies of such third parties.
1.Governing Law: The validity, interpretation, performance, and dispute resolution of this Agreement shall be governed exclusively by the Laws of the Republic of the Philippines.
2.Amicable Negotiation: In the event of any controversy, claim, or dispute arising out of or relating to this Agreement or the loan matchmaking services, the parties shall first attempt to resolve the dispute amicably through good-faith negotiations within thirty (30) days from the receipt of a formal written notice by one party to the other.
3.Exclusive Judicial Jurisdiction: If the dispute cannot be resolved through amicable negotiation, both parties hereby explicitly agree that such dispute shall be submitted to the exclusive jurisdiction of the competent courts of Pasig City or Makati City, Metro Manila, Philippines, to the exclusion of all other courts.
●Severability: If any provision of these Terms is held to be illegal, invalid, or unenforceable under present or future laws, such provision shall be fully severable, and the legality, validity, and enforceability of the remaining provisions shall remain in full force and effect.
●Force Majeure: The Company shall not be held liable for any default or platform downtime resulting from acts of God, shifts in government decrees, large-scale cyber-attacks, or other force majeure events entirely beyond the reasonable control of the Company.
●Validity of Electronic Service: You acknowledge and agree that all legal instruments (such as disclosure statements, statements of account, default notices, etc.) may be lawfully and validly served electronically via the mobile phone number (SMS) or email address you registered on the Platform.
We consistently prioritize user feedback, data compliance rectification applications, and zero-tolerance complaints regarding non-compliant collection activities.
